These Terms and Conditions ("Agreement") establish the legal terms and conditions for your use of our website and services, including purchasing digital downloads and hiring Liv (Olivia Mortimer) for photography services. By accessing, browsing, or making a purchase on this website, you agree to be bound by these terms.

If you do not agree with any part of this Agreement, you should not use our website or purchase our services.

1. Services Overview

Liv (Olivia Mortimer) offers two distinct services:

1.1 Browse & Buy (Public Galleries)

Access publicly available galleries and purchase individual photos or curated photo sets
Each purchase includes a Private Use Digital Download License (detailed in Section 5.1)
Images are delivered as high-resolution JPEG files via email or account download link

1.2 Hire Liv (Olivia Mortimer) (Client Galleries)

Choose from three service packages: Essential, Standard, or Premium
Receive a private, password-protected Client Gallery accessible only to you
Download all agreed-upon images from your gallery
Full usage rights within the scope of your hired package (detailed in Section 5.2)

2. Account & Registration

2.1 Creating an Account

To access certain features (purchasing, Client Gallery access), you may be required to create an account and provide accurate, current information. You are responsible for:

Maintaining the confidentiality of your password
All activities that occur under your account
Notifying us immediately of unauthorized access

2.2 Account Termination

We reserve the right to terminate or suspend your account if you violate these terms, engage in unlawful activity, or pose a risk to our business or other users.

3. Pricing & Payment

3.1 Pricing

All prices are displayed in [Currency] and include applicable taxes unless stated otherwise. Prices may change at any time without notice, but changes will not apply to existing orders.

3.2 Payment Methods

We accept payment via:

Credit/Debit cards (Visa, Mastercard, American Express)
PayPal
Bank transfer (where applicable)

3.3 Payment Processing

Payments are processed securely through third-party payment providers (Stripe, PayPal). We do not store full credit card information. All payment information is encrypted and handled in compliance with industry standards.

3.4 Failed Payments

If a payment fails, we may retry the transaction using the payment method you provided. Multiple failed attempts may result in order cancellation.

3.5 Refunds & Returns

Digital Downloads: Non-refundable after purchase and download. Downloads are final.
Hire Packages: Non-refundable after the session date has occurred or services have begun. Contact us to discuss cancellations before your session.

4. Intellectual Property & Copyright

4.1 Copyright Ownership

All images and visual content on our website and galleries are the exclusive copyright of Liv (Olivia Mortimer). You do not acquire any ownership or intellectual property rights by viewing, downloading, or purchasing images. The copyright, title, and interest in all images remain with Liv (Olivia Mortimer) at all times.

4.2 Photographer's Usage Rights

Liv (Olivia Mortimer) retains the right to use images from all sessions for:

Portfolio and website display
Social media promotion
Marketing materials
Photographic competitions
Professional self-promotion

This includes images from private Client Galleries unless written notice to the contrary is provided one week before or one week after your session date.

4.3 Unauthorized Use

You agree not to:

Reproduce, distribute, publicly display, or sell images without proper licensing
Alter, edit, or modify images beyond basic cropping and color adjustments (unless explicitly permitted)
Remove, obscure, or alter copyright notices or metadata
Use images for commercial purposes without a commercial license
Sublicense, lease, rent, or assign your rights to third parties

Violation of these terms may result in legal action and damages claims.

5. Image Licenses

5.1 Private Use License (Browse & Buy Digital Downloads)

When you purchase a digital download from our public galleries, you receive a non-exclusive, non-transferable license for:

You MAY:

Use images for personal enjoyment and private storage
Share images privately on personal social media profiles
Post on a personal blog or website
Use for personal archives and personal projects
Perform basic editing (cropping, basic color adjustments)
Display in personal physical spaces

You MAY NOT:

Use images for any commercial purpose without a commercial license (advertising, marketing, promotion, merchandise, resale)
Share with or distribute to businesses, bands, venues, event organizers, or third parties for commercial use
Alter images beyond basic cropping/color adjustments
Remove or alter copyright information or metadata
Use for profit-generating activities

Commercial use requires a separate license. Contact us for commercial licensing inquiries.

5.2 Client Use License (Hire Packages)

When you hire Liv (Olivia Mortimer) through one of our service packages (Essential, Standard, Premium), you receive a private Client Gallery with a non-exclusive, non-transferable license for:

You MAY:

Download all images in your private gallery
Use images for personal use
Share images privately with family and friends
Use for self-promotional purposes (e.g., artist/band social media, personal website, portfolio)
Perform basic editing (cropping, basic color adjustments)

You MAY NOT:

Use images for commercial purposes without written permission
Sell, redistribute, or license images to third parties
Alter images substantially or change their character
Remove or alter copyright information
Use images for commercial advertising, marketing, or merchandising

Liv (Olivia Mortimer) reserves the right to use Client Gallery images for portfolio, website, social media, and self-promotion purposes unless you provide written notice one week before or one week after your session.

6. Hiring Liv (Olivia Mortimer) â€“ Session Terms

6.1 Booking & Reservation

Selecting a package reserves the date and time for your session
A non-refundable booking deposit (as specified in your package) secures your booking
The remaining balance is due 7 days before your session date
Failure to pay the balance may result in session cancellation

6.2 Cancellation & Rescheduling

Cancellations must be submitted in writing (email or message).

More than 14 days notice: Booking deposit is forfeited; remaining fees are refunded
7-14 days notice: Booking deposit + 50% of remaining fees are forfeited
Less than 7 days notice: All fees are forfeited (non-refundable)
No-show: All fees are forfeited; a re-booking fee may apply

Rescheduling: If you reschedule within 12 months, your original booking deposit may be applied to the new date.

6.3 Session Timing

You are responsible for arriving on time to your scheduled session
Sessions begin and end at the agreed times
Late arrival may result in loss of session time; Liv (Olivia Mortimer) is not responsible for time lost due to client tardiness
If you arrive more than 30 minutes late, the session may be rescheduled with applicable fees

6.4 Session Location

You are responsible for providing accurate session location details and ensuring the venue is accessible and appropriate for photography.

7. Image Delivery & Galleries

7.1 Gallery Access

Client Galleries are private, password-protected, and accessible only to you. Liv (Olivia Mortimer) is not responsible for unauthorized access due to password sharing or account compromise.

7.2 Download & Delivery

Digital images are provided as high-resolution JPEG files via your private Client Gallery
Images are typically available for download within 20-30 working days of your session (depending on volume and editing requirements)
Gallery access is provided for a limited time period (as specified in your package); you are responsible for downloading and backing up your images
After the access period expires, galleries may be deleted; Liv (Olivia Mortimer) is not responsible for data loss after this period

7.3 Physical Products

Print products, albums, canvases, and other physical items are manufactured by third-party suppliers and typically take 7-14 days to complete. Delivery times depend on local conditions and are not guaranteed.

7.4 No Refunds on Final Products

Once images have been edited and delivered, no refunds are available. All final products (prints, albums, digital files) are considered final.

8. Image Quality & Technical Matters

8.1 Image Selection & Editing

Liv (Olivia Mortimer) selects the final images to be delivered based on professional judgment; clients do not choose individual shots
Standard editing includes: blemish removal, eye brightening, teeth whitening, color correction, exposure adjustments, and stylistic enhancements
Clients agree to accept Liv (Olivia Mortimer)'s professional editing choices and artistic style
No unedited RAW files are provided under any circumstances

8.2 Technical Limitations

Image colors are approximate and may vary from the scene due to lighting conditions and display devices
Exact color matching is not guaranteed
Technical considerations may result in specific shots being unsuitable for delivery
Liv (Olivia Mortimer) is not responsible for images affected by client wardrobe, hair, makeup, or self-presentation issues

8.3 Adverse Conditions

Liv (Olivia Mortimer) is not responsible for session cancellations due to unforeseen circumstances (weather, illness, technical issues, power outages, etc.)
In such cases, sessions will be rescheduled at no additional charge
Liv (Olivia Mortimer) is not responsible for loss of photographs due to weather or environmental conditions beyond reasonable control

9. Client Conduct & Cooperation

9.1 Respectful Conduct

Clients and their guests agree to maintain respectful, cooperative behavior during all sessions. Liv (Olivia Mortimer) reserves the right to terminate a session immediately if:

Verbally or physically abusive behavior occurs
Client or guests are uncooperative or disruptive
Conduct interferes with image quality or session progression

9.2 Client Responsibility for Guests

Clients are fully responsible for the conduct of all guests, family members, and attendees during their session.

9.3 Accuracy of Information

Clients are responsible for providing accurate information about the session (date, time, location, participants, preferences). Liv (Olivia Mortimer) is not responsible for missed shots due to incorrect or incomplete information provided by the client.

10. Limitation of Liability

10.1 Complete Session Failure

In the unlikely event of complete session failure or loss of all images due to technical failure, equipment malfunction, or circumstances beyond Liv (Olivia Mortimer)'s control:

Liv (Olivia Mortimer)'s liability is limited to a refund of fees paid, OR
A rescheduled session at no additional cost

10.2 No Indirect Damages

Liv (Olivia Mortimer) is not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, loss of data, or loss of use.

10.3 Total Liability Cap

In no event shall Liv (Olivia Mortimer)'s total liability exceed the amount paid by the client for the specific session or purchase in question.

11. Indemnification

You agree to indemnify, defend, and hold harmless Liv (Olivia Mortimer), its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your violation of these terms
Your violation of any law or third-party rights
Disputes related to your use of images
Claims arising from your conduct or the conduct of your guests

12. Website Use Restrictions

You agree NOT to:

Violate any applicable laws or regulations
Harass, defame, or abuse other users
Post spam, malware, or harmful content
Attempt to gain unauthorized access to our systems
Scrape, crawl, or use automated tools to collect data from our website
Reproduce, distribute, or republish content without permission
Use our website for commercial purposes (except as explicitly permitted)

Violation of these restrictions may result in account termination and legal action.

13. Social Media & Publicity

13.1 Default Publicity Rights

Liv (Olivia Mortimer) retains the right to post session images to social media (Instagram, Facebook, TikTok, etc.), Liv (Olivia Mortimer)'s website, and for promotional purposes unless you provide written notice.

13.2 Opting Out

If you prefer that your images not be posted publicly, you must notify Liv (Olivia Mortimer) in writing one week before or one week after your session date. Failure to provide timely notice constitutes consent for public posting.

13.3 Personal Information

If you do not want your name, location, or personal details shared on social media, please notify Liv (Olivia Mortimer) in writing within the timeframe specified above.

14. Dispute Resolution & Non-Disparagement

14.1 Good Faith Resolution

In the event of a dispute, both parties agree to attempt resolution in good faith. Contact us with any concerns.

14.2 Non-Disparagement Clause

Clients agree not to post negative reviews, comments, or disparaging statements about Liv (Olivia Mortimer) or services on any platform (social media, review sites, forums, etc.) without first attempting to resolve the issue directly with Liv (Olivia Mortimer).

15. Governing Law & Jurisdiction

These Terms and Conditions are governed by the laws of [Your Jurisdiction] and are subject to the exclusive jurisdiction of the courts located therein. Any legal proceedings must be initiated within one year of the claim arising.

16. Entire Agreement & Modifications

16.1 Entire Agreement

These Terms and Conditions, together with our Privacy Policy and Image Licenses, constitute the entire agreement between you and Liv (Olivia Mortimer) regarding your use of our website and services.

16.2 Modifications

Liv (Olivia Mortimer) reserves the right to modify these terms at any time. Changes are effective upon posting to the website. Your continued use constitutes acceptance of modified terms.

16.3 Severability

If any provision of these terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and all other provisions remain in effect.
